Challenging the Alcotest
In March 2008 the New Jersey Supreme Court found the Alcotest machine to be reliable in an opinion entitled State v. Chun. The Alcotest is a machine used to measure the blood alcohol content (BAC) in impaired drivers. Given the Supreme Court's finding of reliability, the Alcotest has now replacedthe breathalyzer in DWI/DUI cases in New Jersey. The Alcotest has been found to be more accurate than the breathalyzer. As a result, challenging the Alcotest requires a skilled attorney.
Our criminal defense team has handled many DUI/DWI cases; and we understand how to effectively contest BAC readings. In many cases we immediately retain experts who review the police procedures to identify any errors and possible defenses. We attend seminars and classes in order to stay ahead of the prosecution. If you were charged with drinking and driving in New Jersey, we can help.
