Police officer facing criminal charges for disclosing data

|

Anyone can face criminal charges in New Jersey. Even law enforcement officials who are charged with upholding the law sometimes break the law. An Asbury Park police officer was recently arrested and charged with official misconduct. He was later released after paying 10 percent of the bail bond.

The 16-year police force veteran was apprehended by investigators at his home via an official misconduct warrant. If convicted of official misconduct, the officer could be imprisoned for 5-to-10 years.

The 45-year-old officer was also charged with disclosing data by releasing vital information from a protected database. The officer's bail bond was set at $50,000. The officer is currently suspended without pay following his arrest.

A suspect who is a police officer who knows the consequences of criminal charges and how to handle them makes this an interesting case. A person who is facing criminal charges can learn a thing or two from this police officer. First, posting bail is important because it allows for better case preparation for the defendant. Investigating and gathering evidence is rather difficult and risky from inside a detention center. For example, any information obtained by prison guards can be used against the defendant during a trial.

Criminal defense, as the name implies, is about presenting a strong case during a court trial in order to prove innocence. Establishing a strong criminal defense is easier said than done and generally cannot be done effectively alone. Consulting a legal professional can help a defendant understand where he or she stands legally in reference to the case details. A case can be settled through litigation or by entering a plea agreement.
