The Pre-Trial Intervention Program & Diversion Programs

|

The Pre-Trial Intervention (PTI) Program is one of three diversion programs offered in New Jersey.  These diversion programs include the PTI Program, the Conditional Discharge Program and the Conditional Dismissal Program.  Despite varying in the criminal charges that they apply to, they are similar in that each one is an alternative to jail or prison time and result in charge dismissal. If your charge qualifies for one of the programs, it is highly beneficial to apply and complete a diversion program rather than spend time behind bars.  Our team of experienced New Jersey criminal defense attorneys at Law Offices of Joseph R. Donahue, LLC can help you determine if one of the programs applies to you and will guide you through the application process.

The Application Process

There are three main steps in the application process for PTI and other diversion programs:

  1. Complete the application paperwork and schedule an appointment for an interview with your investigator or probation officer.  This interview will involve a background check and evaluation for substance abuse or addiction. If there is a substance abuse issue, additional referrals will be recommended.
  2. The application review will commence including review of your interview, substance abuse evaluation, court correspondence, and any additional case evidence. The review process involves the Judge, County Prosecutor and a PTI Supervisor.
  3. If you are accepted into a program, you will meet with your probation officer, be subject to drug testing and will need to complete all program required classes, community service and additional requirements.

Successful completion of a diversion program will result in dismissal of charges.
